1. Introduction and Acceptance<\/b><\/h2>\n

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Business Registration Center Inc., operating as BRC Host (“BRC Host,” “we,” “us,” or “our”), a corporation registered under the laws of Canada.<\/span><\/p>\n

By creating an account, purchasing a service, or using any BRC Host service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy (“AUP”), all of which are incorporated by reference.<\/span><\/p>\n

If you do not agree to these Terms, do not create an account or use our services.<\/span><\/p>\n

BRC Host reserves the right to refuse service to any individual or entity at its sole discretion.<\/span><\/p>\n

2. Definitions<\/b><\/h2>\n

“Account” means the customer account created upon registration with BRC Host, through which all services are managed and billed.<\/span><\/p>\n

“Addon Products” means optional services available for purchase in addition to a hosting plan, including but not limited to Titan Mail, Website Builder, Premium Backup, SiteLock Security, SpamExperts Email Filtering, Premium SSL Certificates, Dedicated IP Address, and Priority Support.<\/span><\/p>\n

“Billing Cycle” means the recurring period for which a service is billed, corresponding to the term selected at purchase (monthly, 12-month, 24-month, or 36-month).<\/span><\/p>\n

“Content” means all data, files, databases, email messages, website code, images, and any other material stored on or transmitted through BRC Host’s servers by the Customer.<\/span><\/p>\n

“Domain Registration” means the registration or renewal of a domain name through BRC Host’s domain registration service, facilitated through NameSilo as the backend registrar.<\/span><\/p>\n

“Hosting Plan” means the shared web hosting service purchased by the Customer, available in Starter, Business, or Professional tiers.<\/span><\/p>\n

“Resource Allocation” means the CPU, RAM, I\/O throughput, entry processes, and IOPS limits assigned to a Customer’s account as published in the hosting plan specifications and enforced through CloudLinux.<\/span><\/p>\n

“Service” or “Services” means any product or service provided by BRC Host, including hosting plans, domain registration, and addon products.<\/span><\/p>\n

“Term” means the billing period selected at the time of purchase (monthly, 12-month, 24-month, or 36-month).<\/span><\/p>\n

3. Eligibility<\/b><\/h2>\n

To create an account and purchase services from BRC Host, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are purchasing on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.<\/span><\/p>\n

4. Account Registration and Security<\/b><\/h2>\n

4.1 Account Information<\/b><\/h3>\n

You agree to provide accurate, current, and complete information during registration and to update your account information promptly if any details change. BRC Host relies on the contact information on file for all account communications, including billing notices, service notifications, and security alerts.<\/span><\/p>\n

4.2 Account Security<\/b><\/h3>\n

You are responsible for maintaining the confidentiality of your account credentials, including your cPanel password, billing portal login, and any API keys or access tokens. You are responsible for all activity that occurs under your account, whether or not authorized by you.<\/span><\/p>\n

You must notify BRC Host immediately if you become aware of any unauthorized access to your account.<\/span><\/p>\n

4.3 One Account Per Customer<\/b><\/h3>\n

Each customer or business entity may hold one primary account. Multiple hosting plans and domain registrations may be managed under a single account. BRC Host reserves the right to merge or close duplicate accounts.<\/span><\/p>\n

5. Services<\/b><\/h2>\n

5.1 Hosting Plans<\/b><\/h3>\n

BRC Host provides shared web hosting in three tiers: Starter, Business, and Professional. Each plan includes specific resource allocations, features, and limitations as published on the BRC Host website and in the hosting plan specifications at the time of purchase.<\/span><\/p>\n

BRC Host uses CloudLinux to allocate and isolate server resources on a per-account basis. Your account’s resource allocation (CPU cores, RAM, I\/O throughput, entry processes, and IOPS) is published in the plan specifications and guaranteed through CloudLinux Lightweight Virtual Environments (LVE).<\/span><\/p>\n

All hosting plans include, at no additional cost: LiteSpeed web server, free SSL certificate (Let’s Encrypt), Cloudflare CDN integration, SSD storage, unmetered bandwidth, Imunify360 security suite, CageFS filesystem isolation, DDoS protection, daily backups, cPanel control panel, Softaculous application installer, PHP version selector, and email hosting (IMAP, POP3, SMTP, and webmail).<\/span><\/p>\n

5.2 Domain Registration<\/b><\/h3>\n

BRC Host provides domain registration and renewal services using NameSilo as the backend registrar. Domain pricing is set at a 15% margin above NameSilo’s wholesale cost, converted to Canadian dollars.<\/span><\/p>\n

All domain registrations include free WHOIS privacy protection, DNS management, email forwarding, and Domain Defender protection.<\/span><\/p>\n

Domain registration is subject to the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) and the applicable domain registry for the chosen extension. BRC Host acts as an intermediary between the Customer and the registrar. Disputes regarding domain ownership, transfers, or ICANN policies are subject to the applicable registry’s dispute resolution procedures.<\/span><\/p>\n

5.3 Addon Products<\/b><\/h3>\n

Addon products are optional services that may be purchased in addition to a hosting plan. Each addon product has its own pricing, features, and terms as published on the BRC Host website at the time of purchase. Addon products are billed on a monthly cycle unless otherwise specified.<\/span><\/p>\n

5.4 BRC Integration Bundles<\/b><\/h3>\n

BRC Integration Bundles are available exclusively through the BRC incorporation process and include a Starter hosting plan plus one domain registration for the bundle term. Bundles renew at the original bundle rate. Customers on a bundle plan may upgrade their hosting tier at any time; the upgrade is prorated for the remaining term, and the domain registration continues independently.<\/span><\/p>\n

5.5 Free Site Migration<\/b><\/h3>\n

BRC Host provides free site migration for customers switching from another hosting provider, subject to per-plan limits: 1 site for Starter, 3 sites for Business, and unlimited for Professional. Migration includes files, databases, email accounts, and DNS configuration. Standard migrations are completed within 24 to 48 hours of receiving valid credentials. Complex migrations may require 3 to 5 business days.<\/span><\/p>\n

BRC Host makes reasonable efforts to ensure migration accuracy but does not guarantee error-free migration of all data. Customers are provided a 48-hour verification window before DNS is switched to BRC Host’s servers. It is the Customer’s responsibility to verify the completeness and accuracy of the migration during this window.<\/span><\/p>\n

BRC Host is not responsible for data loss or service disruption resulting from incorrect credentials provided by the Customer, incompatible configurations at the previous host, or the Customer’s failure to verify the migration before DNS switchover.<\/span><\/p>\n

6. Pricing, Billing, and Payment<\/b><\/h2>\n

6.1 Flat-Rate Hosting Pricing<\/b><\/h3>\n

BRC Host uses flat-rate pricing for all hosting plans. The price you pay at the time of purchase is the price you pay at renewal. There are no promotional introductory rates, and there are no renewal price increases for existing customers on existing hosting services.<\/span><\/p>\n

If BRC Host adjusts hosting pricing, the new pricing applies only to new purchases and new customers. Existing customers retain their current hosting rate for the service and term they are enrolled in, including upon renewal. If BRC Host ever needs to change this flat-rate hosting pricing commitment, affected customers will receive written notice at least 30 days before their next renewal date.<\/span><\/p>\n

This flat-rate commitment applies to hosting plans only. Domain registration pricing is governed separately under Section 6.2.<\/span><\/p>\n

6.2 Domain Registration Pricing<\/b><\/h3>\n

Domain registration pricing is not fixed at a flat rate. BRC Host prices domains using a transparent margin model: 15% above the wholesale cost charged by NameSilo, the backend registrar, converted to Canadian dollars.<\/span><\/p>\n

Because wholesale registry costs and the CAD\/USD exchange rate can change over time, the Canadian dollar price for domain registration and renewal may change between billing cycles. BRC Host commits to the following with respect to domain pricing:<\/span><\/p>\n

The 15% margin above wholesale cost is fixed. BRC Host will not increase the margin without advance notice to customers. Any change to the margin structure will be communicated by email at least 30 days before taking effect.<\/span><\/p>\n

Pricing is reviewed quarterly against the prevailing CAD\/USD exchange rate and NameSilo’s current wholesale costs. An interim review may be triggered if the CAD\/USD exchange rate reaches 1.42 or if NameSilo announces a wholesale price change affecting BRC Host’s domain catalogue.<\/span><\/p>\n

Domain prices in effect at the time of purchase apply for the full term purchased. If you register or renew a .com domain for one year at the current price, that price is honoured for the full year regardless of subsequent price adjustments. Price changes apply only to new registrations and renewals initiated after the effective date of the change.<\/span><\/p>\n

Renewal pricing for domains is the price in effect at the time of renewal, not the original registration price. BRC Host will display the current renewal price in renewal reminder emails and in the customer billing portal. If the renewal price has changed from the original registration price, the reminder will clearly indicate the new price before any charge is processed.<\/span><\/p>\n

BRC Host does not use promotional first-year pricing or artificial introductory rates on domains. The 15% margin model applies equally to new registrations, transfers, and renewals.<\/span><\/p>\n

6.2 Currency<\/b><\/h3>\n

All BRC Host prices are quoted and billed in Canadian Dollars (CAD).<\/span><\/p>\n

6.3 Payment Processing<\/b><\/h3>\n

Payments are processed through Stripe. BRC Host accepts Visa, Mastercard, and American Express. By providing payment information, you authorize BRC Host to charge the payment method on file for all applicable fees.<\/span><\/p>\n

BRC Host does not store credit card numbers. All payment data is handled by Stripe in compliance with the Payment Card Industry Data Security Standard (PCI DSS).<\/span><\/p>\n

6.4 Billing Cycles and Auto-Renewal<\/b><\/h3>\n

Services are billed in advance for the selected term (monthly, 12-month, 24-month, or 36-month). All services auto-renew at the end of each billing cycle at the same rate, unless the Customer cancels before the renewal date.<\/span><\/p>\n

BRC Host will send a renewal reminder by email at least 14 days before the renewal date. Failure to receive a reminder does not exempt the Customer from the auto-renewal charge.<\/span><\/p>\n

6.5 Term Commitment<\/b><\/h3>\n

When you select a multi-month term (12, 24, or 36 months), you are committing to pay for the full term. The discounted monthly rate reflects this commitment. Early cancellation of a term commitment does not entitle the Customer to a refund of the remaining term, except as provided under the 30-Day Money-Back Guarantee (Section 7).<\/span><\/p>\n

6.6 Failed Payments<\/b><\/h3>\n

If a scheduled payment fails, BRC Host will retry the charge and notify the Customer by email. If payment is not received within 7 days of the original due date, the associated services may be suspended. If payment is not received within 30 days of the original due date, the account and its associated data may be terminated and deleted.<\/span><\/p>\n

6.7 Taxes<\/b><\/h3>\n

Prices listed on the BRC Host website do not include applicable taxes. Goods and Services Tax (GST), Harmonized Sales Tax (HST), Provincial Sales Tax (PST), or Quebec Sales Tax (QST) will be applied based on the Customer’s province or territory of residence, in accordance with Canadian tax law.<\/span><\/p>\n

7. Refund Policy<\/b><\/h2>\n

7.1 30-Day Money-Back Guarantee<\/b><\/h3>\n

New hosting plan purchases are covered by a 30-day money-back guarantee. If you are not satisfied with your hosting service for any reason within the first 30 days of your initial purchase, you may request a full refund of hosting fees paid.<\/span><\/p>\n

The 30-day period begins on the date of the initial hosting purchase. This guarantee applies to the first purchase of a hosting plan only and does not apply to renewals, upgrades, or subsequent purchases.<\/span><\/p>\n

To request a refund, contact BRC Host support via the ticket system or by phone during business hours. Refunds are processed to the original payment method within 10 business days.<\/span><\/p>\n

7.2 Domain Registration Refunds<\/b><\/h3>\n

Domain registration fees are non-refundable. Once a domain is registered, the registry charges BRC Host immediately and these fees cannot be recovered. This applies to new registrations, renewals, and transfers. If a hosting plan refund is issued under the 30-Day Money-Back Guarantee, any associated domain registration fees are excluded from the refund.<\/span><\/p>\n

7.3 Addon Product Refunds<\/b><\/h3>\n

Addon products purchased within the first 30 days of the initial hosting plan purchase are eligible for a refund as part of the money-back guarantee. Addon products purchased after the initial 30-day period are non-refundable for the current billing cycle but will not be renewed if cancelled.<\/span><\/p>\n

7.4 Refund Exclusions<\/b><\/h3>\n

The following are not eligible for refunds: domain registration and renewal fees, Stripe processing fees incurred by BRC Host, services terminated due to violation of these Terms or the Acceptable Use Policy, renewal charges on existing services, and setup or migration fees (if any are applied in the future).<\/span><\/p>\n

8. Service Level Agreement<\/b><\/h2>\n

8.1 Uptime Guarantee<\/b><\/h3>\n

BRC Host guarantees 99.9% network and server uptime, measured on a calendar month basis. This equates to a maximum of 43 minutes and 50 seconds of unplanned downtime per month.<\/span><\/p>\n

8.2 Service Credits<\/b><\/h3>\n

If monthly uptime falls below 99.9%, affected Customers are eligible for a pro-rated service credit applied to their next billing cycle:<\/span><\/p>\n

99.0% to 99.9% uptime: 5% monthly hosting credit. 95.0% to 99.0% uptime: 15% monthly hosting credit. Below 95.0% uptime: 30% monthly hosting credit.<\/span><\/p>\n

Service credits are applied automatically when a qualifying downtime event is confirmed. Service credits do not accumulate across months and may not exceed 30% of the monthly hosting fee in any single month. Service credits are not redeemable for cash.<\/span><\/p>\n

8.3 Exclusions<\/b><\/h3>\n

The uptime guarantee does not cover: scheduled maintenance announced at least 48 hours in advance, force majeure events (natural disasters, war, government action, pandemic), downtime caused by the Customer’s actions or content, third-party service disruptions outside BRC Host’s direct control (upstream network providers, DNS propagation, CDN outages), or DDoS attacks exceeding BRC Host’s mitigation capacity.<\/span><\/p>\n

8.4 Reporting Downtime<\/b><\/h3>\n

To claim a service credit, the Customer must submit a support ticket within 7 days of the downtime event, identifying the date, time, and duration of the outage. BRC Host will verify the claim against internal monitoring data and apply the credit if the claim is substantiated.<\/span><\/p>\n

9. Resource Usage and Fair Use<\/b><\/h2>\n

9.1 Published Resource Limits<\/b><\/h3>\n

Each hosting plan has published resource allocations (CPU cores, RAM, I\/O throughput, entry processes, and IOPS) enforced through CloudLinux. These limits are guaranteed minimums: your account will always have access to the published resources regardless of other customers’ usage.<\/span><\/p>\n

9.2 Resource Overage<\/b><\/h3>\n

If your account consistently exceeds its published resource allocation, BRC Host will notify you with specific usage data and recommend an appropriate plan upgrade. BRC Host does not throttle, degrade, or suspend service without prior notification.<\/span><\/p>\n

If sustained resource overage threatens server stability for other customers, BRC Host may temporarily limit the offending processes after notification and a reasonable window to address the issue (minimum 48 hours, except in cases of immediate server instability).<\/span><\/p>\n

9.3 Prohibited Resource Usage<\/b><\/h3>\n

Regardless of plan tier, the following uses are prohibited and may result in immediate suspension without prior notice: cryptocurrency mining, running background daemons or persistent processes not related to web hosting, operating proxy or VPN services, running IRC servers or bots, and any other activity that consumes disproportionate server resources in a manner inconsistent with shared web hosting.<\/span><\/p>\n

10. Account Suspension and Termination<\/b><\/h2>\n

10.1 Suspension by BRC Host<\/b><\/h3>\n

BRC Host may suspend your account or specific services if: payment is overdue (see Section 6.6), your account violates these Terms or the Acceptable Use Policy, your resource usage threatens server stability for other customers (see Section 9.2), or a legal or regulatory authority requires suspension.<\/span><\/p>\n

Except in cases of immediate threat to server stability, legal requirement, or clear AUP violation (such as malware distribution, phishing, or hosting of illegal content), BRC Host will provide at least 48 hours’ notice before suspension, specifying the reason and any action required to avoid suspension.<\/span><\/p>\n

10.2 Termination by BRC Host<\/b><\/h3>\n

BRC Host may terminate your account if: payment remains overdue for more than 30 days, a suspension condition is not resolved within 14 days of notice, repeated violations of the Terms or AUP occur, or required by law.<\/span><\/p>\n

BRC Host will provide at least 7 days’ notice before termination (except where prohibited by law or where immediate termination is necessary to protect other customers or comply with legal requirements). Upon termination, BRC Host will make reasonable efforts to allow the Customer to retrieve their data within 7 days of the termination notice.<\/span><\/p>\n

10.3 Cancellation by Customer<\/b><\/h3>\n

You may cancel your account or individual services at any time by submitting a cancellation request through the support ticket system. Cancellation takes effect at the end of the current billing cycle. No refunds are issued for the remaining portion of a pre-paid term, except as provided under the 30-Day Money-Back Guarantee (Section 7).<\/span><\/p>\n

Upon cancellation, your data (files, databases, emails) will be retained for 30 days from the cancellation effective date, after which it will be permanently deleted. It is your responsibility to download or migrate your data before the retention period expires.<\/span><\/p>\n

10.4 Domain Handling on Termination or Cancellation<\/b><\/h3>\n

Domain registrations are independent of hosting services. If your hosting is cancelled or terminated, your domain registrations remain active and under your ownership for the duration of their registration term. You may continue to manage your domains through BRC Host or transfer them to another registrar.<\/span><\/p>\n

11. Data, Privacy, and PIPEDA Compliance<\/b><\/h2>\n

11.1 Data Storage Location<\/b><\/h3>\n

All Customer data (website files, databases, email messages, and backups) is stored on servers physically located in Montreal, Quebec, Canada. BRC Host does not transfer or replicate Customer data to servers outside of Canada.<\/span><\/p>\n

11.2 Privacy<\/b><\/h3>\n

BRC Host collects, uses, and protects personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Full details are provided in the BRC Host Privacy Policy, which is incorporated into these Terms by reference.<\/span><\/p>\n

11.3 Data Ownership<\/b><\/h3>\n

You retain full ownership of all Content you store on BRC Host’s servers. BRC Host does not claim any intellectual property rights over your Content. BRC Host accesses Customer Content only as necessary to provide the Services (such as performing migrations, backups, or responding to support requests) or as required by law.<\/span><\/p>\n

11.4 Backups<\/b><\/h3>\n

BRC Host performs daily backups of all hosting accounts. Standard backups are retained for 7 days. Customers on the Premium Backup addon receive backups every 6 hours with 30-day retention.<\/span><\/p>\n

While BRC Host makes reasonable efforts to maintain backup integrity, backups are provided as a convenience and not as a guaranteed data recovery service. BRC Host is not responsible for data loss resulting from backup failure. Customers are strongly encouraged to maintain their own independent backups.<\/span><\/p>\n

12. Acceptable Use<\/b><\/h2>\n

Your use of BRC Host services is subject to the Acceptable Use Policy (AUP), published separately and incorporated into these Terms by reference. Violations of the AUP may result in account suspension or termination as described in Section 10.<\/span><\/p>\n

13. Intellectual Property<\/b><\/h2>\n

13.1 BRC Host Intellectual Property<\/b><\/h3>\n

The BRC Host name, logo, website design, documentation, and proprietary tools are the intellectual property of Business Registration Center Inc. You may not use BRC Host’s trademarks, trade names, or branding without prior written permission.<\/span><\/p>\n

13.2 Customer Content<\/b><\/h3>\n

You represent and warrant that you own or have the legal right to use all Content stored on your hosting account, and that your Content does not infringe the intellectual property rights of any third party. BRC Host is not responsible for the Content hosted on your account and does not monitor Content for intellectual property compliance.<\/span><\/p>\n

13.3 DMCA and Copyright Complaints<\/b><\/h3>\n

BRC Host will respond to valid copyright infringement notices in accordance with applicable Canadian law and international copyright agreements. To report copyright infringement, contact BRC Host at the address listed in Section 20. BRC Host reserves the right to remove or disable access to infringing content and to terminate the accounts of repeat infringers.<\/span><\/p>\n

14. Third-Party Services<\/b><\/h2>\n

BRC Host integrates with or relies upon the following third-party services to deliver its products: NameSilo (domain registration), WHC.ca (server infrastructure and data centre), Stripe (payment processing), Cloudflare (CDN and DDoS protection), Imunify360 (server security), Let’s Encrypt (SSL certificates), Softaculous (application installer), and various addon product providers (Titan Mail, SiteLock, SpamExperts, Sectigo).<\/span><\/p>\n

BRC Host is not responsible for the availability, performance, or policies of third-party services. Changes to third-party services, pricing, or terms may affect BRC Host’s ability to provide certain features. BRC Host will notify Customers of material changes resulting from third-party service modifications.<\/span><\/p>\n

15. Limitation of Liability<\/b><\/h2>\n

15.1 Service Provided “As Is”<\/b><\/h3>\n

Except as expressly stated in these Terms (including the uptime guarantee in Section 8), BRC Host provides its services on an “as is” and “as available” basis. BRC Host does not warrant that services will be uninterrupted, error-free, or free of security vulnerabilities.<\/span><\/p>\n

15.2 Limitation of Damages<\/b><\/h3>\n

To the maximum extent permitted by applicable law, BRC Host’s total aggregate liability for all claims arising out of or relating to these Terms or the use of Services shall not exceed the total fees paid by the Customer to BRC Host during the 12-month period immediately preceding the event giving rise to the claim.<\/span><\/p>\n

BRC Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or costs of procurement of substitute services, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if BRC Host has been advised of the possibility of such damages.<\/span><\/p>\n

15.3 Force Majeure<\/b><\/h3>\n

BRC Host shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, government action, pandemic, epidemic, power outages, telecommunications failures, or failures of third-party infrastructure providers.<\/span><\/p>\n

16. Indemnification<\/b><\/h2>\n

You agree to indemnify, defend, and hold harmless Business Registration Center Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of BRC Host services, your Content, your violation of these Terms or the AUP, your violation of any applicable law or regulation, or your infringement of any third party’s intellectual property or other rights.<\/span><\/p>\n

17. Governing Law and Jurisdiction<\/b><\/h2>\n

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.<\/span><\/p>\n

18. Dispute Resolution<\/b><\/h2>\n

18.1 Informal Resolution<\/b><\/h3>\n

Before initiating any formal dispute resolution proceedings, the parties agree to attempt to resolve any dispute informally by contacting BRC Host support. BRC Host will make reasonable efforts to address the concern within 14 business days.<\/span><\/p>\n

18.2 Formal Proceedings<\/b><\/h3>\n

If informal resolution fails, either party may pursue formal dispute resolution through the courts of the Province of Ontario, Canada, as specified in Section 17.<\/span><\/p>\n

19. Modifications to Terms<\/b><\/h2>\n

BRC Host reserves the right to modify these Terms at any time. Material changes will be communicated to Customers by email at least 30 days before the changes take effect. Non-material changes (such as formatting corrections, clarifications that do not alter rights or obligations, or updates to contact information) may be made without advance notice.<\/span><\/p>\n

Continued use of BRC Host services after the effective date of a modification constitutes acceptance of the revised Terms. If you do not agree with a material modification, you may cancel your services before the modification takes effect and receive a pro-rated refund for any pre-paid but unused portion of your current term.<\/span><\/p>\n

20. General Provisions<\/b><\/h2>\n

20.1 Entire Agreement<\/b><\/h3>\n

These Terms, together with the Privacy Policy and the Acceptable Use Policy, constitute the entire agreement between you and BRC Host regarding the use of our Services, and supersede any prior agreements or communications.<\/span><\/p>\n

20.2 Severability<\/b><\/h3>\n

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.<\/span><\/p>\n

20.3 Waiver<\/b><\/h3>\n

The failure of BRC Host to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of BRC Host.<\/span><\/p>\n

20.4 Assignment<\/b><\/h3>\n

You may not assign or transfer your account or any rights or obligations under these Terms without the prior written consent of BRC Host. BRC Host may assign its rights and obligations under these Terms without restriction.<\/span><\/p>\n

20.5 Notices<\/b><\/h3>\n

All notices from BRC Host to the Customer will be sent to the email address on file. It is the Customer’s responsibility to ensure their contact email is current and monitored. Notices from the Customer to BRC Host should be submitted through the support ticket system or sent to the contact address below.<\/span><\/p>\n
