These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Business Registration Center Inc., operating as BRC Host ("BRC Host," "we," "us," or "our"), a corporation registered under the laws of Canada.
By creating an account, purchasing a service, or using any BRC Host service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy ("AUP"), all of which are incorporated by reference.
If you do not agree to these Terms, do not create an account or use our services.
BRC Host reserves the right to refuse service to any individual or entity at its sole discretion.
"Account" means the customer account created upon registration with BRC Host, through which all services are managed and billed.
"Addon Products" means optional services available for purchase in addition to a hosting plan, including but not limited to Titan Mail, Website Builder, Premium Backup, SiteLock Security, SpamExperts Email Filtering, Premium SSL Certificates, Dedicated IP Address, and Priority Support.
"Billing Cycle" means the recurring period for which a service is billed, corresponding to the term selected at purchase (monthly, 12-month, 24-month, or 36-month).
"Content" means all data, files, databases, email messages, website code, images, and any other material stored on or transmitted through BRC Host's servers by the Customer.
"Domain Registration" means the registration or renewal of a domain name through BRC Host's domain registration service, facilitated through NameSilo as the backend registrar.
"Hosting Plan" means the shared web hosting service purchased by the Customer, available in Starter, Business, or Professional tiers.
"Service" or "Services" means any product or service provided by BRC Host, including hosting plans, domain registration, and addon products.
To create an account and purchase services from BRC Host, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are purchasing on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
4.1 Account Information
You agree to provide accurate, current, and complete information during registration and to update your account information promptly if any details change.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your cPanel password, billing portal login, and any API keys or access tokens. You must notify BRC Host immediately if you become aware of any unauthorized access to your account.
4.3 One Account Per Customer
Each customer or business entity may hold one primary account. BRC Host reserves the right to merge or close duplicate accounts.
5.1 Hosting Plans
BRC Host provides shared web hosting in three tiers: Starter, Business, and Professional. All hosting plans include: LiteSpeed web server, free SSL certificate (Let's Encrypt), Cloudflare CDN integration, SSD storage, unmetered bandwidth, Imunify360 security suite, CageFS filesystem isolation, DDoS protection, daily backups, cPanel, Softaculous, PHP version selector, and email hosting.
5.2 Domain Registration
BRC Host provides domain registration and renewal services using NameSilo as the backend registrar. Domain pricing is set at a 15% margin above NameSilo's wholesale cost, converted to Canadian dollars. All domain registrations include free WHOIS privacy protection, DNS management, email forwarding, and Domain Defender protection.
5.3 Addon Products
Addon products are optional services billed on a monthly cycle unless otherwise specified.
5.4 BRC Integration Bundles
BRC Integration Bundles include a Starter hosting plan plus one domain registration for the bundle term. Customers on a bundle plan may upgrade their hosting tier at any time.
5.5 Free Site Migration
BRC Host provides free site migration subject to per-plan limits: 1 site for Starter, 3 sites for Business, and unlimited for Professional. Standard migrations are completed within 24 to 48 hours. BRC Host is not responsible for data loss resulting from incorrect credentials or the Customer's failure to verify the migration before DNS switchover.
6.1 Flat-Rate Hosting Pricing
BRC Host uses flat-rate pricing for all hosting plans. The price you pay at the time of purchase is the price you pay at renewal — no promotional introductory rates and no renewal price increases for existing customers.
6.2 Domain Registration Pricing
Domain pricing uses a transparent margin model: 15% above the wholesale cost charged by NameSilo, converted to Canadian dollars. Pricing is reviewed quarterly. Domain prices in effect at the time of purchase apply for the full term purchased.
6.3 Currency
All BRC Host prices are quoted and billed in Canadian Dollars (CAD).
6.4 Payment Processing
Payments are processed through Stripe. BRC Host accepts Visa, Mastercard, and American Express. BRC Host does not store credit card numbers. All payment data is handled by Stripe in compliance with PCI DSS.
6.5 Billing Cycles and Auto-Renewal
Services are billed in advance for the selected term and auto-renew at the end of each billing cycle. BRC Host will send a renewal reminder by email at least 14 days before the renewal date.
6.6 Failed Payments
If payment is not received within 7 days of the due date, services may be suspended. If payment is not received within 30 days, the account and its data may be terminated and deleted.
6.7 Taxes
GST, HST, PST, or QST will be applied based on the Customer's province or territory of residence, in accordance with Canadian tax law.
7.1 30-Day Money-Back Guarantee
New hosting plan purchases are covered by a 30-day money-back guarantee. This applies to the first purchase of a hosting plan only and does not apply to renewals, upgrades, or subsequent purchases.
7.2 Domain Registration Refunds
Domain registration fees are non-refundable once a domain is registered.
7.3 Addon Product Refunds
Addon products purchased within the first 30 days of the initial hosting plan purchase are eligible for a refund. Addon products purchased after the initial 30-day period are non-refundable for the current billing cycle.
7.4 Refund Exclusions
The following are not eligible for refunds: domain registration and renewal fees, Stripe processing fees, services terminated due to Terms violations, and renewal charges.
8.1 Uptime Guarantee
BRC Host guarantees 99.9% network and server uptime, measured on a calendar month basis.
8.2 Service Credits
If monthly uptime falls below 99.9%, affected Customers are eligible for pro-rated service credits: 99.0%–99.9% uptime: 5% credit; 95.0%–99.0%: 15% credit; below 95.0%: 30% credit. Credits are not redeemable for cash.
8.3 Exclusions
The uptime guarantee does not cover scheduled maintenance, force majeure events, downtime caused by the Customer's actions, or DDoS attacks exceeding BRC Host's mitigation capacity.
Each hosting plan has published resource allocations enforced through CloudLinux. BRC Host does not throttle or suspend service without prior notification. Prohibited uses include cryptocurrency mining, running background daemons, proxy or VPN services, IRC servers or bots.
10.1 Suspension by BRC Host
BRC Host may suspend your account for overdue payment, Terms/AUP violations, resource overage, or legal requirements. Except in cases of immediate threat, BRC Host will provide at least 48 hours' notice before suspension.
10.2 Termination by BRC Host
BRC Host will provide at least 7 days' notice before termination and will make reasonable efforts to allow data retrieval within 7 days of the termination notice.
10.3 Cancellation by Customer
You may cancel at any time via the support ticket system. Your data will be retained for 30 days from the cancellation effective date, after which it will be permanently deleted.
10.4 Domain Handling
Domain registrations are independent of hosting services and remain active under your ownership for the duration of their registration term.
All Customer data is stored on servers physically located in Montreal, Quebec, Canada. BRC Host does not transfer Customer data to servers outside of Canada. BRC Host collects and protects personal information in accordance with PIPEDA. You retain full ownership of all Content stored on BRC Host's servers.
BRC Host performs daily backups retained for 7 days. Customers on the Premium Backup addon receive backups every 6 hours with 30-day retention. Backups are provided as a convenience and not as a guaranteed data recovery service.
Your use of BRC Host services is subject to the Acceptable Use Policy (AUP), published separately and incorporated into these Terms by reference.
The BRC Host name, logo, website design, documentation, and proprietary tools are the intellectual property of Business Registration Center Inc. You may not use BRC Host's trademarks or branding without prior written permission. You represent that you own or have the legal right to use all Content stored on your account.
BRC Host integrates with third-party services including NameSilo, WHC.ca, Stripe, Cloudflare, Imunify360, Let's Encrypt, and Softaculous. BRC Host is not responsible for the availability or policies of third-party services.
BRC Host's total aggregate liability for all claims shall not exceed the total fees paid by the Customer during the 12-month period preceding the event giving rise to the claim. BRC Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, loss of data, or loss of business opportunity.
You agree to indemnify and hold harmless Business Registration Center Inc., its officers, directors, employees, and affiliates from any claims arising out of your use of BRC Host services, your Content, or your violation of these Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
Before initiating formal proceedings, the parties agree to attempt to resolve any dispute informally. BRC Host will make reasonable efforts to address concerns within 14 business days.
Material changes will be communicated by email at least 30 days before taking effect. Continued use of BRC Host services after the effective date constitutes acceptance of the revised Terms.
These Terms, together with the Privacy Policy and the Acceptable Use Policy, constitute the entire agreement between you and BRC Host. If any provision is found unenforceable, the remaining provisions remain in full force and effect.

You have read, understood and agree to the terms and conditions of the Registrant Agreement, and that CIRA may, from time to time and at its discretion, amend any or all of the terms and conditions of the Registrant Agreement, as CIRA deems appropriate, by posting a notice of the changes on the CIRA website and by sending a notice of any material changes to Registrant.
You meet all the requirements of the Registrant Agreement to be a Registrant, to apply for the registration of a Domain Name Registration, and to hold and maintain a Domain Name Registration, including without limitation CIRA's Canadian Presence Requirements for Registrants.
